The Chair referred to the above planning applications included on the planning schedule for today’s meeting.  He advised that a site visit request had been submitted by Members, which he agreed to accept and therefore both applications would be deferred and presented at a future meeting of the Planning Committee.

Correspondence from Friend of the Earth, Northern Ireland

Minutes:

The Chair referred to correspondence received from the Friends of the Earth (NI) dated 14 August 2020, regarding NIEA operational policy on Ammonia emitting projects.  He confirmed that the correspondence had been emailed to Members of Committee for information and a report on the issue would be presented at the next Planning Committee meeting.

Minutes:

The Head of Planning in response to Councillor Kelly’s request for an update on the above application, advised that legal advice was sought and was currently being considered after which a formal update would be presented at a future meeting of the Planning Committee.

 

The Lead Legal Services Officer agreed to provide an update on the legal position of the above matter under confidential business later in the meeting.

The purpose of the above report was for Planning Case Officers to present to Members the following planning applications for decision, details of which had been previously circulated to Members together with late information if applicable. 

 

Application deferred for further information to be submitted

 

LA11/2019/0559/O – Dwelling and garage on the farm, 140m South West of 1 Kittybane Road, Newbuildings, Derry.

 

The PPO presented the above application, details of which had been previously circulated to Members.  She provided a recap of the current status of the application and, based on material consideration and in line with planning policy, recommended a refusal for reasons as outlined within the report.

 

The Members accepted speaking rights from Mr Chris Cassidy, Agent after which they could seek points of clarification if they so wished.

The Chair invited Members to seek points of clarification from the PPO.

The PPO clarified that the supporting information regarding invoices were not verifiable in terms of meeting the test of active farming and therefore did not meet Planning policy.

 

Councillor McGuire stated that he would be of the view that the receipts/invoices submitted by the applicant were connected to the farm holding and in that regard was minded not to accept the PPO’s recommendation to refuse planning permission.

 

Councillor McGuire proposed, seconded by Alderman Kerrigan to overturn the recommendation to refuse planning permission and for approval to be granted subject to standard conditions.

 

Councillor Dobbins joined the meeting.

 

The outcome of the vote:  For 8, Against 4, Abstention 0.  The proposal was carried and the Committee

 

Resolved            to overturn the recommendation to refuse planning application LA11/2019/0559/O and for planning approval to be granted subject to standard conditions.

 

New Applications

 

LA11/2018/1205/F – 4 No. single storey retail units and associated car parking within vacant land.  Proposal also includes a new access to be located between rear of No. 1 Temple Court & No. 6 Upper Galliagh Road (access being taken from Upper Galliagh Road) on land to the east of the existing Whitehouse Retail Park,65 Buncrana Road, BT48 8LB, adjacent to rear of 1-6 (inclusive) Temple Court.

 

The Senior Planning Officer presented the above application, details of which had been previously circulated to Members.  He provided an overview of the background to the application and, based on material consideration and in line with planning policy, recommended an approval subject to the conditions as outlined within the report.

 

The Members accepted speaking rights from Mr Jim O’Hagan, Objector.

 

The Chair invited Members to seek points of clarification from Mr Jim O’Hagan if they so wished.

 

Councillor Harkin commended the objector for his involvement in these issues and asked how strong the feeling was amongst the residents in relation to alternative usage of the land.
