The Head of Planning reported that the above application, which was included on the schedule and presented as a refusal due to a DfI (Roads) issue, that new information had been provided late and therefore the application would be deferred for further consideration and recommendation presented at a future meeting.

There was a short recess to allow Members the opportunity to review the late information received before the following applications would be presented.
APPLICATIONS RETURNED AFTER SITE INSPECTIONS ON 18 SEPTEMBER 2019
LA11/2017/0251/F - Retention of part change of use from agricultural building to dog/cat kennels at 511 Glenshane Road, Killycor, Londonderry.
The Principal Planning Officer (PPO) presented the above application, details of which had been previously circulated to Members and confirmed the Members in attendance at the site visit on 18th September 2019 were: Cllr Jackson, Cllr Dobbins, Cllr Boyle, Cllr McKinney, Cllr Barr, Ald McClintock and Ald Bresland She provided an overview of the background to the application and, based on material consideration and in line with planning policy, recommended a refusal for reasons as outlined within the report.
The Members received speaking rights from the following representatives and sought points of clarification in relation to the application:
· Mr Pascal Diamond, Objector.
· Mr Gary Middleton, MLA who spoke on behalf of the applicant.
· Mr Bob Campbell, Agent representing the applicant.
· Ms Andree Johnston who spoke in support of the application.
· Mr Graeme Rosborough, Applicant.
The PPO in response to Members’ queries confirmed that, as outlined within the report, the refusal reason was due to insufficient demonstration that the development would not create a noise nuisance nor harm the amenities of residents. She added that the application was based on change of use of agricultural building to dog/cat kennels and the recommendation was based on the evidence provided to date and inline with planning policy.
The Environmental Health Officer clarified that the video footage provided could not determine the location of the noise of a dog barking. He also confirmed that no formal complaint of noise nuisance had been received by Environmental Health Department.
Discussion ensued after which Councillor Boyle moved, seconded by Councillor Gallagher to accept the PPO’s recommendation to refuse planning permission for reasons as outlined.
The outcome of the vote; For 6, Against 5, Abstention 1. The proposal was carried.
Resolved that planning application LA11/2017/0251/F be refused planning permission for reasons as outlined within the report.
LA11/2018/0481/F - Construction of 1 No. detached split level dwelling with car port and garden store at lands opposite Nos 1 to 8 Hazelwood Avenue, Prehen Road, Derry.
The PPO presented the above application, details of which were previously circulated to Members and confirmed the Members in attendance at the site visit on 18th September 2019 were : Cllr Jackson, Cllr Dobbins, Cllr Boyle, Cllr McKinney, Cllr Barr, Ald McClintock and Ald Bresland She provided an overview of the background to the application and, based on material consideration and in line with planning policy, recommended a refusal for reasons as outlined within the report.
Councillor McKinney left the meeting.
